1. Acceptance of Terms

By accessing or using Flipswitch ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

Flipswitch is a feature flag management platform that allows developers to control feature rollouts, run experiments, and manage application configuration through a dashboard and SDKs. The Service includes the web dashboard, APIs, and client SDKs.

3. Beta Disclaimer

The Service is currently in beta. It is provided on an "as-is" and "as-available" basis. Features may change, be removed, or experience downtime without prior notice. Paid plans with an uptime SLA are subject to the Service Level Agreement. All other usage carries no uptime guarantees during the beta period.

4. Account Responsibilities

When using the Service, you agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials and API keys.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to gain unauthorized access to the Service or other accounts.
• Use the Service to store or transmit malicious code.
• Exceed reasonable usage limits or abuse the API.

6. Intellectual Property

The Service, including its design, code, and documentation, is owned by Flipswitch and protected by intellectual property laws. You retain ownership of your data, including feature flag configurations and application data you submit to the Service. We claim no ownership over your content.

7. Limitation of Liability

To the maximum extent permitted by law, Flipswitch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may stop using the Service at any time by deleting your account. We reserve the right to suspend or terminate your access if you violate these terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export your data before deletion.

9. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated terms.
